Welcome to Mxtrackr (“Mxtrackr,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Mxtrackr website, mobile applications, and related services (collectively, the “Platform”).

By creating an account or using Mxtrackr, you agree to these Terms. If you do not agree, do not use the Platform.

1. What Mxtrackr Provides

Mxtrackr is a software-as-a-service (SaaS) platform that allows users to:

• Track riding activity and performance
• Log bike maintenance and equipment usage
• Record race results and riding history
• Manage bikes, parts, and service schedules
• Enable tour companies and service providers to manage bikes, customers, and bookings

Mxtrackr provides digital tools only. We do not provide physical services, mechanical work, training, or riding supervision.

2. Eligibility

You must be at least 18 years old (or the age of majority in your region) to create an account. If you are under 18, a parent or legal guardian must agree to these Terms on your behalf.

You are responsible for ensuring that your use of the Platform complies with all local laws and regulations.

3. Accounts

To use certain features, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

4. User Data & Content

You may upload or enter information including:

• Ride logs and performance data
• Maintenance records
• Equipment details
• Photos, notes, and race results
• Business data (for tour operators or service providers)

You retain ownership of your content. By using Mxtrackr, you grant us a worldwide, non-exclusive license to host, store, process, and display your content solely to operate and improve the Platform.

You are responsible for ensuring your content:

• Is accurate
• Does not infringe others’ rights
• Does not contain unlawful, abusive, or harmful material

We may remove content that violates these Terms.

5. Health, Safety & Mechanical Disclaimer

Riding motorcycles, bicycles, off-road vehicles, or participating in races and tours involves inherent risk, including serious injury or death.

Mxtrackr:

• Does not guarantee the accuracy of ride tracking, maintenance logs, or performance data
• Does not provide mechanical, safety, or professional advice
• Is not responsible for decisions you make regarding riding, training, equipment, or maintenance based on Platform data

You are solely responsible for:

• Ensuring your vehicle is safe and properly maintained
• Following manufacturer and professional mechanical advice
• Riding safely and within your ability

6. Tour Companies & Service Providers

If you use Mxtrackr as a tour company, rental provider, mechanic, or service business:

• You are solely responsible for the services you provide to customers
• Mxtrackr is not a party to agreements between you and your customers
• You are responsible for compliance with consumer, safety, and business laws
• You must ensure all booking, waiver, and safety documentation is accurate and legally valid

Mxtrackr is not liable for injuries, damages, disputes, cancellations, or service failures between businesses and their customers.

8. Acceptable Use

You agree not to:

• Use the Platform for unlawful purposes
• Interfere with or disrupt the Platform
• Attempt to access other users’ data without permission
• Upload viruses or malicious code
• Reverse engineer or copy the Platform

We may suspend or terminate accounts that misuse the service.

9. Intellectual Property

All software, design, logos, and content provided by Mxtrackr (excluding user content) are owned by us or our licensors and protected by intellectual property laws.

You may not copy, modify, distribute, or resell any part of the Platform without our written permission.

10. Third-Party Services

Mxtrackr may integrate with third-party services (such as GPS devices, payment processors, or app stores). We are not responsible for third-party services, their availability, or their data practices.

Your use of third-party services is governed by their own terms.

11. Service Availability

We aim to keep Mxtrackr available but do not guarantee uninterrupted or error-free service. Features may change, be removed, or updated at any time.

We may suspend the Platform for maintenance, updates, or security reasons.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

To the maximum extent permitted by law, Mxtrackr disclaims all warranties, including:

• Fitness for a particular purpose
• Accuracy of data tracking or maintenance logs
• Reliability or availability of the Platform

13. Limitation of Liability

To the fullest extent permitted by law, Mxtrackr and its team will not be liable for:

• Injuries, accidents, or damages arising from riding or mechanical failure
• Loss of data, profits, or business opportunities
• Indirect, incidental, or consequential damages

Our total liability for any claim related to the Platform will not exceed the amount you paid us in the 12 months before the claim.

14. Termination

You may stop using Mxtrackr at any time.

We may suspend or terminate your access if you violate these Terms or use the Platform in a harmful or unlawful way.

15. Privacy

Your use of Mxtrackr is also governed by our Privacy Policy, which explains how we collect and use personal data.

16. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will provide notice through the Platform or by email. Continued use of Mxtrackr means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of Australia without regard to conflict of law principles.
